Welcome to Fashion Arc — Bangladesh’s first dedicated virtual fashion mall. We bring small to big clothing and apparel brands together on one platform so discovery feels effortless, checkout stays frictionless, and multi-brand orders come with consolidated delivery to cut repetitive shipping costs. By using our website (fashionarc.co), mobile app, or any related services (collectively, the “Platform”), you agree to these Terms of Service. In these Terms: “You”, “Your”, “User” - refers to you, the person accessing or using the Platform. “We”, “Us”, “Our”, “Fashion Arc” - refers to Fashion Arc. “Brands”, “Sellers” - refers to the fashion brands (small to big) that collaborate and list products on the Platform. “Platform” - refers to our website, mobile app, and all related services. We may update or modify these Terms at any time. Changes will be posted on the Platform and become effective immediately upon posting. Your continued use of the Platform after any changes constitutes your acceptance of the updated Terms. These Terms are governed by the laws of the People's Republic of Bangladesh, including (but not limited to) the Digital Commerce Operational Guidelines 2021, Consumer Rights Protection Act 2009, and Information and Communication Technology (ICT) Act 2006. Any disputes shall be subject to the exclusive jurisdiction of the courts in Dhaka, Bangladesh.

2. Account & Usage

[Please refer to the for more details.] Privacy Policy Creating and maintaining an account To access certain features of the Fashion Arc Platform — such as browsing personalized recommendations, saving items to your wishlist, placing orders, tracking consolidated multi-brand deliveries, and redeeming first-order coupons — you must create a user account. When registering, you agree to:

Provide accurate, current, and complete information about yourself as prompted during the registration process (including full name, valid mobile number, email address, and delivery address).
Update your account information promptly whenever it changes so that we and our collaborating Brands can contact you, process orders correctly, and deliver products to the right location. You are solely responsible for the accuracy of the information you provide. Providing false, incomplete, or misleading information may result in suspension or permanent termination of your account, cancellation of orders, or other restrictions on your use of the Platform. Account security and responsibility You are fully responsible for:
Maintaining the confidentiality of your account login credentials (username/email, password, and any other authentication methods we may provide).
All activities that occur under your account, whether authorized by you or not. You agree to:
Immediately notify us at hello@fashionarc.co or via phone/WhatsApp (01736988266) if you become aware of any unauthorized use of your account or any other breach of security.
Ensure that you log out from your account at the end of session,when accessing the Platform from a shared or public device. We will not be liable for any loss or damage arising from your failure to comply with these account security obligations. Age requirement You must be at least 18 years old to create an account and use the Platform independently. If you are under 18 years of age, you may only use the Platform under the supervision of a parent or legal guardian who agrees to these Terms on your behalf. One account per person Each individual is allowed to maintain only one active Fashion Arc account. Creating multiple accounts to gain unfair advantages (such as repeated use of first-order coupons, promotional discounts, or other benefits) is strictly prohibited and may result in immediate suspension of all associated accounts and forfeiture of any benefits. Account suspension or termination We reserve the right, at our sole discretion and without prior notice, to:
Suspend or terminate your account
Restrict your access to the Platform
Cancel any pending or completed orders
Remove or edit content you have submitted If we reasonably believe that you have violated these Terms, engaged in fraudulent activity, misused promotions, harmed the Platform or any collaborating Brand, or for any other reason we deem necessary to protect the integrity of Fashion Arc, our users, or our partner Brands. You may close your account at any time by contacting us. Upon closure, you will lose access to order history, saved items, wishlist, and any unused promotional benefits (such as coupons or membership perks), unless otherwise required by law.

Orders & Payments [Please refer to the for more details.] Payment Policy & Shipping and delivery policy Placing an order When you place an order on the Fashion Arc Platform, it constitutes a legal offer to the respective Brand to purchase the selected product(s) at the displayed price and terms. All orders are subject to availability of stock and final acceptance by the Brand. The order is not considered accepted until the respective Brand confirms dispatch of the product(s). Dispatch confirmation typically occurs within a few hours, depending on the Brand’s processing time. You may receive one or more separate dispatch notifications if your order includes products from multiple Brands or is fulfilled in multiple packages. We indicate approximate processing and delivery timelines when you place the order. These are estimates only and not guaranteed, as they depend on the Brand's stock, preparation time, and third-party delivery partners. We make reasonable efforts to meet these timelines, but delays may occur. Stock availability note Since most collaborating Brands do not provide us with real-time API integration, product availability displayed on the Platform may not always reflect live stock in every corner case. We make every effort to keep inventory data accurate and up-to-date through manual updates when necessary. However, until the Brand confirms the order and dispatch, Fashion Arc is not liable for any product unavailability or inability to fulfill the order due to stock shortages. Consolidated multi-brand orders To reduce repetitive delivery charges and consumer hassle, orders containing products from multiple Brands may be combined for a single consolidated delivery. This allows you to receive everything in one shipment (where operationally possible), lowering overall shipping costs compared to separate orders from individual brands. Order confirmation and changes After you place an order, we or the Brand may contact you to verify details (such as phone number, delivery address, or payment information) to prevent fraud or errors. If we are unable to verify or if you do not respond, the order may be cancelled automatically. Pricing and availability All prices are listed in Bangladeshi Taka (BDT) and inclusive of applicable VAT, as set by the Brand. Prices shown on the product page are final at the time of viewing, but placing an item in your cart does not reserve or lock the price. Prices may change (increase or decrease) before checkout due to Brand updates. We do not offer price matching with other websites or platforms. Availability information is provided on product pages, but stock levels can change rapidly. If a product becomes unavailable after you place an order, we will notify you via email or SMS and cancel that part of the order (or the full order if necessary). Order cancellation rights

Brands retain the right to cancel any order prior to dispatch at their sole discretion (for example, due to stock unavailability or pricing errors). We will inform you promptly via email or SMS.
We reserve the unqualified right to cancel any order prior to dispatch, at any time and without liability, for reasons including (but not limited to) suspected fraud, payment verification issues, technical/typographical errors, mispricing, out-of-stock items, defective products, or any other reason we deem necessary to protect the Platform, users, or collaborating Brands.
You may cancel your order at no cost at any time before the item is dispatched. Payments During the current pre-launch/trial period, we facilitate secure payment processing through trusted local service providers, including bKash, Nagad, Rocket, Upay, and Cash on Delivery (COD) where available (Verifying using transaction id). The actual payment contract is strictly between you and the respective payment service provider (and, for any prepaid electronic methods, your issuing provider or bank). You are responsible for all fees, costs, charges, and applicable taxes associated with your purchases as per prevailing Bangladeshi law. Refunds for cancelled orders [Please refer to the for more details.] Return, Refund, and Exchange Policy If an order (or part of an order) is cancelled before dispatch — whether by you, the respective Brand, or Fashion Arc — any prepaid amount will be refunded in accordance with our Refund Policy. Refunds are processed to your original payment method (bKash, Nagad, bank transfer, etc.) within 2–10 working days after we receive and inspect the returned item(s). In many cases — especially for defect-related returns — we complete the refund within 24 hours after approval. The refund amount covers the full cost of the returned product(s). If any delivery or return shipping charge is due (e.g., for preference returns or partial returns), it will be deducted from the refund amount before processing. In exceptional circumstances (such as bank holidays, technical issues with payment providers, or high-volume periods), processing may take longer. We will make reasonable efforts to process refunds as quickly as possible. Any applied discounts, promotional vouchers, first-order coupons, or shipping fees will be adjusted accordingly during the refund calculation. 4. Consolidated Delivery

[Please refer to the for more details.] Shipping and delivery policy To reduce delivery costs and hassle, multi-brand orders may be combined into a single shipment where possible. Products are collected directly from Brand warehouses by our delivery partners. This helps eliminate repetitive delivery fees compared to separate orders. Delivery Timelines

Same-city orders (within Dhaka or your city): 1-4 working days.
Inter-city orders (outside your city): 3-6 working days.
Peak seasons (Eid, Pohela Boishakh, etc.): May take 1–2 extra days — we communicate delays clearly via order updates. These align with Digital Commerce Operational Guidelines 2021 (max 5 days same-city, 10 days different city). Actual time may vary due to Brand processing, location, and external factors. Tracking updates will be sent via email, SMS, or app. We continuously work to optimize this process to provide the lowest possible delivery costs and the best possible experience for our users.

Product Listing and Size Guide Standards [ For complete details, please see our full Product Listing Policy .] Only verified and onboarded brands are permitted to list products on Fashion Arc. Third-party sellers or unauthorized individuals are strictly prohibited from listing any products without our explicit prior consent. To ensure authenticity, accuracy, and a confident shopping experience, every product must include the following mandatory information (clearly visible before adding to cart):

Accurate Product Title – Clear, descriptive, and non-misleading (e.g., “Women’s Premium Cotton Kurti – Navy Blue – Size M – Hand Embroidered Neckline”).
Detailed & Honest Description – Fabric feel, style notes, occasion, special features, and any limitations. No exaggeration of quality, fit, or origin.
Genuine Pricing – Final price including any discount clearly shown. No fake “original price” to inflate discounts.
Material & Specification – Exact fabric composition (e.g., 100% cotton, 60% cotton 40% polyester), transparency, stretch level, lining, closure type, sleeve length, neck design, color description (with note on possible variation due to lighting or screen settings), and full care instructions (washing, ironing, drying, and special care guidelines).
High-Quality Real Images – Minimum 4–6 clear photos from multiple angles (front, back, side, close-up of fabric, stitching, and tags). No stock photos, watermarked, or misleading edited images.
Detailed Size Chart – Complete measurements in inches and centimeters for all sizes (Bust, Waist, Hip, Length, Shoulder, Sleeve, etc.), along with fit notes (e.g., “True to size”, “Runs small – order one size up”, “Relaxed fit”) and a body measurement guide. [Please refer to the for more details.] Size Guide and Fit policy We maintain a strict two-level verification process :
Brands may upload products via API integration, our team listing, or self-listing through the brand dashboard.
Every listing (especially self-uploaded) requires Fashion Arc admin review and approval before going live on the marketplace. Any listing found to be inaccurate, low-quality, spam-like, counterfeit, or misleading will be rejected or immediately removed .

Prohibited Activities [Please refer to the for more details.] Acceptable Use Policy You may not use the Fashion Arc Platform for any unlawful, fraudulent, harmful, or abusive purpose. The following activities are strictly prohibited and may result in immediate suspension or permanent termination of your account, cancellation of orders, removal of content, and/or reporting to relevant authorities:

Engaging in fraud, misrepresentation, deceptive practices, false advertising, or any form of scam (including fake reviews, artificially inflating ratings, or misleading product descriptions).
Harassment, bullying, threats, abusive language, hate speech, discrimination, or any form of offensive behavior toward other users, Brands, or Fashion Arc staff.
Posting, uploading, sharing, or transmitting spam, unsolicited messages, chain letters, bulk advertising, or any form of commercial solicitation not authorized by Fashion Arc.
Violating the intellectual property rights of any third party, including copyright, trademark, patent, design rights, or any other proprietary rights (for example, uploading unauthorized images, logos, or content belonging to other brands).
Engaging in any activity that breaches Bangladeshi law, these Terms of Service, or any applicable regulation, including (but not limited to):
The Digital Commerce Operational Guidelines 2021
The Consumer Rights Protection Act 2009
The Information and Communication Technology (ICT) Act 2006
The Cyber Security Act 2023
Any other laws relating to e-commerce, consumer protection, intellectual property, or online conduct
Attempting to gain unauthorized access to the Platform, any user account, or any Brand data.
Interfering with the normal operation of the Platform, including introducing viruses, malware, harmful code, or any technology that disrupts service.
Using multiple accounts to circumvent restrictions, exploit promotions, abuse coupons, or gain unfair advantages.
Impersonating any person or entity, or falsely representing your affiliation with any individual, Brand, or organization. Fashion Arc reserves the right to investigate any suspected violation of these rules and take appropriate action, which may include (but is not limited to) account suspension/termination, order cancellation, content removal, and cooperation with law enforcement authorities. By using the Platform, you agree that you will not engage in any of the above activities or any other conduct that could damage the reputation, integrity, or functionality of Fashion Arc, its users, or its collaborating Brands.

6. Intellectual Property

All intellectual property rights in the Fashion Arc Platform are protected under applicable laws of Bangladesh and international conventions. Platform-owned content All content on the Platform that is created or provided by Fashion Arc — including (but not limited to) text, graphics, designs, logos, icons, the “Fashion Arc” name and logo, user interface elements, software, and any other materials developed by or for Fashion Arc — is owned by Fashion Arc or its licensors. These materials are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and view this content solely for personal, non-commercial use in connection with browsing and shopping on the Platform. You may not copy, reproduce, modify, distribute, transmit, display, perform, publish, license, create derivative works from, transfer, or sell any such content without our prior express written permission. Brand-provided content All product images, videos, descriptions, logos, trademarks, brand names, and other materials provided by collaborating Brands remain the exclusive property of the respective Brands or their licensors. By listing products on the Platform, Brands grant Fashion Arc a limited, non-exclusive, royalty-free license to use, display, reproduce, and promote these materials solely for the purpose of operating the Platform, showcasing products, and carrying out agreed marketing activities (such as product stories, posts, community shares, and campaign features) as outlined in the Brand Collaboration Agreement. You (as a user) may not download, copy, reproduce, modify, distribute, display, or create derivative works from any Brand-provided content without the express permission of the respective Brand and Fashion Arc. Prohibited actions You agree not to:

Use any content from the Platform (whether Fashion Arc-owned or Brand-provided) for commercial purposes outside of purchasing products for personal use.
Remove, obscure, or alter any copyright, trademark, or other proprietary notices contained in any content.
Use any meta tags, framing techniques, or other methods to enclose or replicate any Fashion Arc or Brand trademark, logo, or proprietary content without written permission.
Attempt to reverse-engineer, decompile, or extract any part of the Platform’s underlying technology or content. Infringement reporting If you believe that any content on the Platform infringes your intellectual property rights, please contact us immediately at fashionarc.co@gmail.com with detailed information (including proof of ownership, description of the infringing material, and location on the Platform). We will review valid claims promptly and take appropriate action, which may include removal of the content. Fashion Arc respects the intellectual property rights of others and expects all users and collaborating Brands to do the same.

7.Disputes & Complaints

If any issue arises with your order, delivery, return, refund, product quality, brand service, or the platform itself, please contact us first — we aim to resolve most matters quickly and fairly within 24–72 hours via in-app chat, email (fashionarc.co@gmail.com), or phone/WhatsApp (+8801736988266). We act as a neutral mediator between you and the brand (especially for multi-brand orders, where we take full responsibility to coordinate resolution). If the issue remains unresolved after our best efforts, you may escalate it to the Directorate of National Consumer Rights Protection (DNCRP) under the Consumer Rights Protection Act 2009. Limitation of Liability To the fullest extent permitted by applicable law, Fashion Arc, its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages arising from or in connection with:

Your use of or inability to use the Platform
Any reliance placed on any information, content, or materials available on the Platform
Any products or services offered or provided by collaborating Brands
Any unauthorized access to or use of your account or personal information Fashion Arc acts solely as a platform that facilitates connections between users and collaborating Brands. We do not own, control, manufacture, store, inspect, or guarantee the quality, safety, legality, authenticity, accuracy, or availability of any products or services offered by Brands. All commercial terms, including but not limited to product quality, pricing, warranties, and after-sales service, are strictly between you and the respective Brand. Accordingly, Fashion Arc shall not be responsible or liable for:
The acts, omissions, representations, warranties, or conduct of any Brand or third-party service provider (including payment gateways and delivery partners)
Any defective, damaged, incorrect, counterfeit, unsafe, or non-delivered products
Any disputes, claims, losses, or damages arising from transactions between you and any Brand
Any failure by a Brand to fulfill an order, honor a warranty, process a return, or provide accurate product information Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under the laws of Bangladesh. In no event will our total liability to you exceed the amount (if any) you paid to Fashion Arc in the previous 12 months. These limitations of liability apply even if any remedy fails for its essential purpose. 9.Anti-Fraud and Security Summary [For full details, see our complete Anti-Fraud and Security Policy .] Fashion Arc takes security and fraud prevention very seriously to protect you, our collaborating brands, and the platform. We use strong measures including one-way password hashing, no storage of full card details, brand identity verification during onboarding, monitoring for abusive returns or suspicious orders, and prompt investigation of fraud reports. Never share login details, OTPs, or payment info with anyone claiming to represent us — we will never ask for these. If you spot fraud, phishing, fake listings, or suspicious activity, report it immediately via in-app chat, email (hello@fashionarc.co), or phone/WhatsApp (+8801736988266). We comply with Bangladesh laws (Penal Code 1860, ICT Act 2006, Bangladesh Bank guidelines) and work with authorities when needed.

Our consolidated delivery system — gathering products from multiple brands into one shipment — significantly cuts repetitive deliveries, packaging waste, and carbon emissions. We encourage brands to use organic, recycled, and low-impact fabrics, practice ethical sourcing, and adopt low-waste production methods. We also promote accurate size guides to minimize returns and encourage the use of recyclable or biodegradable packaging. 11. Changes to Terms

Fashion Arc reserves the right to update, modify, add, or remove any part of these Terms of Service at any time and at our sole discretion. If we make material changes (changes that significantly affect your rights or obligations, such as major updates to fees, liability, prohibited activities, or key user protections), we will provide reasonable notice before the changes take effect. This notice may be given through:
